Real estate transactions: How a real estate lawyer can help

On Behalf of | Jul 28, 2017 | Real Estate Transactions

Most Texas residents employ real estate brokers to assist them in carrying out their real estate transactions. A seller’s real estate agent can be helpful in finding a purchaser for your property. A buyer’s agent can be helpful in finding a property to buy.

Although a real estate agent can take you from the beginning to the end of your real estate transaction, there are certain tasks a real estate agent cannot perform when it comes to the legal aspects of a sale. For example, if legal questions arise — like whether the zoning of a property is sufficient for its intended business purpose — a real estate lawyer may be required to evaluate the correct answers to those questions.

A real estate lawyer can also be helpful to determine if the property that’s up for sale is “marketable.” This involves an investigation to ascertain whether the seller of a specific property has the legal right to sell it. To prove marketability, the seller must show proof of title to the entire property. The seller must also show that there aren’t any third parties with an undisclosed interest in the property’s title.

Finally, because the buyer-seller agreement to transfer ownership of real estate property falls under the general principles of United States contract law, it could be helpful to have a real estate lawyer on hand in case a contract disagreement arises.

For these and other reasons, many consumers employ an attorney to guide them through their real estate transactions. A real estate lawyer can assist you in your purchase or sale of a piece of property.
